The Amendment
A Vision and Path Forward Provided by the Past
Proposed Constitutional Amendment: Jubilee of Debt Forgiveness and Restoration of Economic Sovereignty
Section 1. Jubilee Declaration
In recognition of the moral, financial, and constitutional crisis facing the people of the United States, and in accordance with the original spirit of liberty, justice, and biblical law, the People of the United States do declare a National Jubilee, to be held once every 50 years, beginning with the ratification of this Amendment.
Section 2. Debt Forgiveness
Upon each Jubilee, the following shall occur:
- All non-fraudulent, unsecured debts owed by individuals and families shall be discharged in full, with no legal, financial, or credit-related penalty.
- Predatory lending contracts, including those exceeding constitutionally defined interest limits, shall be declared null and void.
- No individual or household may be compelled to pay interest on loans originated more than seven years prior to the Jubilee year.
Section 3. Land Restoration
- Any land held by absentee entities (corporate, trust, or foreign) for a period exceeding 10 years without active local development or residence may be subject to public reclamation and redistribution, as defined by law.
- Citizens whose homes rest upon land encumbered by exploitative ownership structures (e.g., private equity, institutional trusts) may petition the state for sovereign title to the land upon which they reside, subject to review and approval under a state-run Homestead Restoration Tribunal.
Section 4. Usury Ban
- No lender, public or private, may charge interest exceeding a rate defined by federal statute, not to exceed 10% annually.
- Compound interest on personal, educational, or consumer debt is hereby prohibited.
- The trading or bundling of consumer debt without the debtor’s explicit consent is outlawed.
Section 5. Jubilee Fund and State Enforcement
- A federally chartered Jubilee Trust Fund shall be created to support states in the administration of debt relief, land audits, and public record corrections.
- States may form Jubilee Commissions with legal authority to audit, review, and enforce the provisions of this Amendment.
- States retain the right to expand the Jubilee framework locally, provided no law infringes on the relief or restoration guaranteed by this Amendment.
Section 6. No Discrimination in Forgiveness
- No person shall be excluded from the benefits of this Amendment on the basis of income, age, race, sex, religion, credit history, incarceration, or immigration status.
- Debtors who are deceased shall have their eligible debts expunged posthumously, and their families relieved of inherited obligations.
Section 7. Sovereign Financial Reset
- A public audit of the Federal Reserve, all U.S. banking institutions, and their ownership of securitized debt shall be conducted within 12 months of ratification.
- Any financial institution found guilty of obstruction, fraud, or profiteering from artificially inflated debt instruments shall be stripped of its charter and fined accordingly.
Section 8. Enabling Clause
Congress and the States shall have the power to enforce this Amendment through appropriate legislation. This Amendment shall take effect immediately upon ratification.
